Witness — Terms of Service

1. Acceptance of terms
By downloading, installing, or using the Witness mobile application (“App,” “Witness,” or “the Service”) you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Cankat Saraç, the developer and operator of Witness.
2. ⚠ Content, emotional, and identity disclaimer
Witness simulates a short conversation with a generated representation of yourself at age 80. The simulation is produced by an AI image-editing model that ages a single selfie, a premade text-to-speech voice from a stock voice library chosen by the apparent gender of your ten-second voice sample (Witness does not clone your real voice), and a large language model that writes responses according to a fixed system prompt.
The aged portrait, the synthesized voice, and the replies are not a real prediction of your future, a real memory, or any kind of medical, psychological, financial, or life-planning advice. The replies are statistically generated text.
If you are experiencing mental-health difficulties, grief, depression, anxiety, suicidal ideation, or any acute distress, please seek help from a qualified clinician or crisis service in your country. Witness is not a therapeutic tool and does not substitute for professional support. In a mental-health emergency contact a crisis line in your country (e.g., 988 Suicide & Crisis Lifeline in the US, Samaritans at 116 123 in the UK).
3. Description of service
Witness lets you capture a single selfie that an AI image model ages, record a ten-second voice sample processed locally to choose a premade older voice, have a short conversation with the aged portrait in voice and text, optionally provide a short bio and social-handle context (Pro), and optionally subscribe to Witness Pro. Witness does not run a social network. Conversations are not shared with anyone else.
4. Eligibility
4.1 Minimum age
You must be at least 13 years old to use Witness. Users in the European Economic Area must be at least 16 years old, or must have verifiable parental or guardian consent.
4.2 Legal capacity
You represent that you have the legal capacity to enter into these Terms in your jurisdiction.
4.3 Identity authenticity and consent
You represent that the selfie and the voice sample you provide are of you, the actual user of the device, and that you have the legal capacity to consent to biometric processing as described in the Privacy Policy. You may not submit the face or voice of any other person. Submitting the imagery or voice of another individual without their explicit, informed consent is a material breach of these Terms and may also violate biometric-privacy statutes (BIPA, CUBI, etc.) and right-of-publicity laws. You agree to indemnify us against any claim arising from your breach of this clause.
5. User-generated content
5.1 Ownership
You retain ownership of the content you generate inside Witness — the aged portrait, the conversation text, and the synthesized audio replies.
5.2 License you grant to us
To operate the App for you, you grant us a limited, non-exclusive, royalty-free, worldwide license to transmit your selfie to the AI image service, transmit your conversation text to the AI text service, and transmit reply text to the text-to-speech service, solely to generate the aged portrait, the voiced replies, and the conversation. This license terminates as soon as the relevant inference call completes.
5.3 No training
We do not direct any of our service providers to use your selfie, voice sample, or conversation text to train their models. Where the provider’s own terms confirm an “API inputs not used for training” position (e.g., OpenAI’s published API data-use policy), that position governs.
6. Witness Pro (subscriptions)
6.1 Pro features
Witness Pro unlocks features that may include extended capacity, additional capture or reset options, contextual mode (bio and social context), and access to new capture formats as they ship.
6.2 Plans
Witness Pro is offered as one or more of: Monthly (recurring), Annual (recurring), and Lifetime (single one-time purchase, never renews). Prices are displayed in your local currency at purchase.
6.3 Billing and auto-renewal
Recurring subscriptions are billed through Apple App Store or Google Play. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
6.4 Free trial
If a free trial is offered, Apple or Google will capture your payment method at trial start and will charge you at the end of the trial unless you cancel.
6.5 Cancellation
Cancel through the platform store: iOS → Settings → [Your Name] → Subscriptions → Witness; Android → Google Play → Subscriptions → Witness. The App cannot cancel subscriptions on your behalf, consistent with Apple App Store Review Guideline 3.1.1 and Google Play policy.
6.6 Refunds
Refunds are handled by Apple or Google according to their respective policies. We do not independently process refunds.
6.7 Restore purchases
A Restore Purchases option is available on the paywall and in account settings.
6.8 EU and UK right of withdrawal
If you are a consumer in the EU or UK, the 14-day right of withdrawal for digital content is presented and captured by the platform store at checkout in accordance with EU Directive 2011/83/EU (as amended) and the UK Consumer Contracts Regulations 2013. The platform store is the seller of record for the withdrawal right.
7. Intellectual property
All elements of Witness — including code, design, prompts, voice-selection logic, copy, and brand — are the intellectual property of Cankat Saraç, protected by copyright, trademark, and other applicable IP law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for personal, non-commercial purposes. You may not copy, modify, reverse-engineer, decompile, or use the App or its outputs to build a competing product (including by training another AI on Witness outputs). You may not submit any image or audio that depicts a person other than yourself.
8. Prohibited uses
You agree not to use Witness to violate any law or third-party right, misrepresent a person’s likeness or voice, generate content intended to deceive, harass, defame, or impersonate, bypass safety filters of the upstream AI services, or probe, scan, or stress the App or its backing services. We may suspend or terminate access at any time for material breach.
9. Disclaimers and limitation of liability
9.1 “As is” service
The App is provided “as is” and “as available” without warranties of any kind, express or implied.
9.2 Output accuracy
We do not warrant that the aged portrait is accurate, flattering, or representative of any real future state. We do not warrant that the older self’s replies are accurate, helpful, comforting, or appropriate to your situation.
9.3 No professional advice
Nothing in Witness constitutes medical, mental-health, legal, financial, or other professional advice.
9.4 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CANKAT SARAÇ, HIS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR INTANGIBLE LOSSES, FROM ANY USE OR INABILITY TO USE THE APP, FROM AI OUTPUT ERRORS, OR FROM EMOTIONAL RESPONSES TO THE SIMULATION. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (b) USD $10.
9.5 EU and UK consumer rights
Nothing in these Terms affects your statutory rights under mandatory EU or UK consumer-protection law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Cankat Saraç, his affiliates, and their respective directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of or access to the App, your violation of these Terms, your violation of any law or any third-party right (including biometric-privacy and right-of-publicity laws), and your submission of any image or audio that is not of yourself.
11. Third-party services
Witness integrates with fal.ai, ElevenLabs, the Rork Toolkit (relaying to OpenAI’s GPT-4o), RevenueCat, and the Apple App Store / Google Play Store. Each is governed by its own terms. We are not responsible for those services.
12. Modifications
We may modify, suspend, or discontinue the App at any time, with or without notice. We may revise these Terms; material changes are communicated via in-app notice on the next launch. Continued use after the effective date of revised Terms is acceptance.
13. Termination
You may terminate by uninstalling the App. We may terminate or suspend your access for material breach (in particular, breach of the identity authenticity clause in Section 4.3). No refund of unused subscription time is owed beyond what applicable law and platform store policies require.
14. Governing law and dispute resolution
14.1 Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles.
14.2 Informal resolution
You agree to contact us at cankatsarac@gmail.com and attempt informal resolution for at least 30 days before bringing any formal claim.
14.3 Arbitration (non-EU / non-UK)
For users outside the EU and UK, disputes not resolved informally shall be submitted to binding individual arbitration under the Rules of the Istanbul Arbitration Centre (ISTAC), seated in Istanbul, Türkiye, in English. You waive any right to participate in class actions or class arbitration. If the class waiver is held unenforceable for a particular dispute, the remainder of this Section 14 remains in effect.
14.4 EU and EEA users
You may bring proceedings in the courts of your country of residence and benefit from mandatory consumer protections. EU ODR platform: https://ec.europa.eu/consumers/odr.
14.5 UK users
You may bring proceedings in the courts of England and Wales, Scotland, or Northern Ireland as applicable.
15. General provisions
Entire agreement. These Terms and the Privacy Policy are the entire agreement between us about the App.
Severability. Unenforceable provisions are severed; the remainder continues.
Waiver. Failure to enforce is not waiver.
Assignment. You may not assign these Terms. We may assign to a successor in connection with merger, acquisition, or sale of assets.
No partnership. These Terms create no partnership, joint venture, employment, or agency relationship.
15.6 Apple-specific terms (iOS users)
If you obtained the App through the Apple App Store, you acknowledge:
- These Terms are concluded between you and Cankat Saraç only, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to the App, including product-liability, conformity, and consumer-protection or biometric-privacy claims.
- We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party IP infringement claim relating to the App.
- You represent that you are not located in a country subject to a US-government embargo or designated as a “terrorist supporting” country, and that you are not on any US-government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
